These Terms of Service (“Terms”) govern your access to and use of Readless (“Readless”, “we”, “us”, or “our”). By using Readless, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Description of Service

Readless provides an AI-powered email newsletter digest service that collects newsletters via a custom email address and delivers summaries on your chosen schedule. Core capabilities include newsletter ingestion, AI summarization, and flexible delivery scheduling.

2. Accounts and Eligibility

• You must be at least 13 years old to use the Service.
• You must provide accurate, current account information and keep your credentials secure.
• You are responsible for activities that occur under your account and for notifying us of any unauthorized use.

3. Acceptable Use

• Comply with all applicable laws and regulations.
• Do not infringe intellectual property or privacy rights when submitting or processing content.
• Do not introduce malware, attempt to bypass security, or disrupt the Service.
• Do not share account credentials or use the Service for unauthorized commercial purposes.
• Do not attempt to reverse engineer, probe, or extract underlying models or systems.

4. Third-Party Integrations

• The Service integrates with third-party services to provide core functionalities. These include Clerk for user authentication, Stripe for payment processing, and Brevo for email delivery.
• By using our Service, you agree to be bound by the terms and privacy policies of these third-party providers. We are not responsible for the practices of these services.
• We do not store your full payment details. All payment information is securely handled by Stripe.

5. Plans, Billing, and Payment

• Paid features are billed via Stripe on a subscription basis and auto‑renew for the applicable billing period unless cancelled.
• You can cancel anytime from your account; access remains until the end of the current billing period.
• Upgrades and downgrades may be prorated in accordance with Stripe’s standard proration rules.
• Fees are stated before purchase and are non‑refundable except as required by law.

6. Free Trial and Refunds

• New users may receive a 7‑day free trial of Pro features (or as otherwise presented at checkout).
• No refunds are provided once a free trial has started or for any subscription charges.
• You can cancel at any time; your subscription remains active through the end of the current billing cycle.

7. Content, Data, and Intellectual Property

• We do not use your content to train our own AI models. Processing by third‑party AI providers is subject to their data‑use policies.
• All Readless software, branding, and site content are owned by Readless and protected by intellectual property laws.

8. Data Retention and Deletion

We retain account data and processed newsletter content only as long as needed to operate the Service and fulfill the purposes outlined here. You may request deletion of your account and associated data; we will process such requests in a reasonable timeframe except where retention is required by law or for legitimate business purposes (e.g., fraud prevention, accounting).

9. AI Processing and Accuracy

• Summaries are generated using AI and may contain errors or omissions. Always refer to the original source for critical information.
• Readless makes no warranty regarding the completeness, accuracy, or reliability of AI‑generated content. Use is at your own discretion and risk.

10. Suspension and Termination

• We may suspend or terminate access for violations of these Terms, harmful behavior, or non‑payment. You may terminate your account at any time via settings.

11. Disclaimer; Limitation of Liability

• The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
• To the maximum extent permitted by law, Readless is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from your use of the Service.

12. Indemnification

You agree to defend, indemnify, and hold harmless Readless and its affiliates, employees, and agents from claims and liabilities arising from your use of the Service or violation of these Terms.

13. Changes to the Service or Terms

We may modify the Service and these Terms at any time. Material changes will be communicated in‑app or by email with reasonable notice. Your continued use after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States.

15. Force Majeure

Neither party is liable for delays or failures caused by events beyond reasonable control, including natural disasters, acts of government, internet or provider outages, labor disputes, or failures of third‑party AI providers.

16. Assignment

We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign your rights or obligations without our prior written consent.

17. Severability; Waiver; Entire Agreement

If any provision is held invalid, the remaining provisions will remain in full force and effect. No waiver will be effective unless in writing. These Terms constitute the entire agreement between you and Readless regarding the Service.
